1. Agreement

The Terms and conditions detailed in this document serve as a binding agreement for the participation and use of the True Indie Movies website and online store for all users.

By submitting a title(s), browsing, purchasing a title(s) on the True Indie Movies online store, all users accept and agree to the terms and conditions and all the policies and instructions outlined throughout the True Indie Movies website and online store.

True Indie Movies reserves the right to change terms and conditions, policies, instructions, website appearance, services offered, and any other function of the True Indie Movies company, website, or online store.

Abuse of any type of the True Indie Movies website, online store, or any service offered by True Indie Movies will constitute in the termination of the agreement and continued service to the SELLER or BUYER without refund.

2. Indemnity

SELLER or BUYER agrees to indemnify and hold True Indie Movies, its officers, employees, subsidiaries, affiliates, attorneys, accountants, agents, assigns and all other persons acting for its benefit or on its behalf, harmless from and against any claim, dispute, demand or expense, including costs and attorney's fees by any third party including but not limited to claims or disputes arising from or related to SELLER’S infringement of the intellectual property rights of any third party and/or the content of the title(s), or any breach of this AGREEMENT.

3. Returns, exchanges, refunds

True Indie Movies will issue only exchanges for the same exact title when possible if the item received is damaged or defective. Notification is required for defective products.

If a DVD does not play on a DVD player, it may not be due to product defect. Therefore, an exchange is possible. We encourage SELLERs to check their title(s) before submitting to True Indie Movies. BUYERs also assume the responsibility for having the proper equipment to view the DVDs in their entirety without any problems.

If any item is returned, it must be properly packaged and shipped, and the BUYER assumes all costs and responsibility for the returned item(s).

Refunds to SELLERs for participation fees may be issued in special circumstances, but they will be prorated according to the amount of time title(s) was online.

4. Site Access

True Indie Movies reserves the right to conduct routine maintenance, updates, upgrades, or general service to the site, and we are not liable or responsible for any possible resulting issues. The True Indie Movies site access will depend these routine activities, which may also compromise performance or speed. There are no guarantees of site performance or server reliability.

5. Copyright

In order to comply with the Digital Millennium Copyright Act, we are providing the following notice of our Copyright Agent:

If any user of the True Indie Movies site discovers infringement of intellectual property by a seller, they are required to notify True Indie Movies in writing with all the proper information to support the alleged infringement including a statement and the proper identification of all parties involved.
